Welcome to the Baby Depot Web site, owned and operated by Baby Depot, Registered Company in Ireland No. 388280.

By using the Baby Depot Web site YOU AGREE TO BE BOUND BY ITS CONDITIONS OF USE (explained below) and PRIVACY POLICY and all disclaimers and terms and conditions that appear elsewhere on the Baby Depot Web site. These Conditions of Use apply to all product transactions on this site. Please read them carefully. They do not affect your statutory rights.

References to “Baby Depot” “We” or “Us” herein refer to Baby Depot Limited, or its affiliates, subsidiaries and designees as deemed appropriate by Baby Depot. The Customer is “you”, the person, persons or company purchasing products and/or services from Baby Depot.

Baby Depot reserves the right to make changes to the Web site and its Terms and Conditions at any time. Each time you use the site, you should visit and review the then current Terms and Conditions, Legal Notices and Privacy Policy that apply to your transactions and use of this site. If you are dissatisfied with the Baby Depot Web site, its content or Terms and Conditions and Legal Notices, you agree that your sole and exclusive remedy is to discontinue using the Baby Depot Web site.

Tampering with the site, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on the site are prohibited.

Warranties, Disclaimers and Limitation of Liability

1. By using the Baby Depot Web site, you expressly agree that use of the Web site is at your sole risk. The Baby Depot Web site is provided on an "AS IS" and "as available" basis. Neither Baby Depot, its affiliates, subsidiaries or designees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, "Associates") warrant that use of the Baby Depot Web site will be uninterrupted or error-free.

2. Neither Baby Depot nor its Associates warrant the accuracy, integrity or completeness of the content provided on the Web site or the products or services offered for sale on the Web site. Baby Depot and its Associates specifically disclaim all warranties, whether expressed or implied, including but not limited to warranties of title, merchantability, compatibility or fitness for a particular purpose. No oral advice or written information given by Baby Depot or its Associates shall create a warranty. User hereby acknowledges that all responsibility for their purchase choice lies with them and it is the customer’s obligation to ensure compatibility between items.

3. Under no circumstances shall Baby Depot or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use the Web site, including but not limited to reliance by you on any information obtained from the Web site that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance. The foregoing Limitation of Liability shall apply in any action, whether in contract, tort or any other claim, even if an authorised representative of Baby Depot has been advised of or should have knowledge of the possibility of such damages. User hereby acknowledges that this paragraph shall apply to all content, merchandise and products, and services available through the Baby Depot Web site.

Intended for Users Over 13

4. The Baby Depot Web site is intended for use by individuals 13 years of age or older. The Baby Depot Web site is not directed for use by children under the age of 13. Users under the age of 13 should get the assistance of a parent or guardian to use this site.

Product Display & Colours

5. The Baby Depot Web site attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the colour you see matches the product colour, as the display of the colour depends, in part, upon the monitor you are using.

Description of Goods

6. All images, descriptive matter, specifications in our advertisements, relayed by telephone and on the Internet are for the sole purpose of giving an approximate description. Full details of specifications are available from manufacturer’s websites. If you find any errors in our descriptions, we appreciate being notified by emailing customerservice@babydepot.ie.

7. Every effort has been made to ensure the accuracy of all information contained in the website. The vast amount of products and details makes it inevitable that descriptive mistakes will occasionally occur. Baby Depot makes no warranty expressed or implied with respect to accuracy of the information, including price, product descriptions and reviews, or product specifications.

8. Baby Depot makes every effort to supply the goods as advertised but reserves the right to supply the goods subject to minor variations in actual dimensions and specifications where these are changed by the manufacturer.

Product Availability

9. Prices, offers, and availability of products and services are subject to change without notice. The pace of e-commerce selling makes it inevitable that changes will be necessary and that mistakes will occasionally occur. Stock is updated each morning but at times, items can go quickly out of stock. Errors will be corrected where discovered, and Baby Depot reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged.

10. Orders are created when payment is received and has cleared funds. In the unlikely event that your order cannot be fulfilled for any reason, you will be offered an alternative of equivalent quality and price. If this is not satisfactory to you, you will be given a full refund. Individual bank policies will dictate when this amount is credited to your credit card or bank account.

11. If you are not fully satisfied with your purchase, you may return it in accordance with Baby Depot Return Policies.

Guarantees

12. Free product guarantees listed in product pages refer directly to the specific manufacturer’s offering. Further details can be found on the specific manufacturer’s websites. Baby Depot, and its affiliates, will not be held responsible for any product guarantee and all queries should be directed to the manufacturer.

VAT Policy

13. Because Baby Depot does business throughout Ireland and collects and remits VAT as required by law, the Baby Depot Web site also collects and remits VAT as appropriate. Please note: Baby Depot reserves the right not to sell to resellers.

Payment

14. Payment can be made by major credit cards, bank draft, postal orders or cheques. Bank transfer can also be arranged by contacting customerservice@babydepot.ie. Please note that if you choose to pay by cheque, the order is created when the cheque has been cleared (about 5-7 working days).

Your Order

15. After you place an order using our shopping cart, we will check the information you give us for validity, by verifying your method of payment and/or shipping address. Due to the rise in credit card fraud, we will need to manually review your order. Sometimes we may either need to speak with you before processing the order or ask you to email or fax over additional ID.

16. On receipt of your order, Baby Depot will send you an order acknowledgment email detailing the products ordered. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the e-mail address you have given us with the order and will refund any taken monies promptly.

Returns Policy

17. 10-Day Approval Guarantee: We will credit most products provided that the following terms are met.

a) You are required to notify us in writing by e-mail, online form, or by post within the ten (10) day time period upon receipt of goods.

b) You then must have the goods returned to Baby Depot within fourteen (14) days of receipt of the goods by post (for small lightweight items) or by our courier (for larger and/or heavier items).

c) The guarantee approval period begins on the day you receive your goods and ends ten (10) calender days later.

d) You are under a duty to take reasonable care of the goods. This means that goods must be in fully re-saleable condition, in their original “as new” packaging, and undamaged, and unopened in any way. All returned orders will be inspected by our trained staff to verify “as new” condition. Baby Depot will deem that you have not taken reasonable care of the goods if they have been damaged in your possession, (or in transit whilst being returned) or used.

e) You are responsible for the cost of the delivery back to us. We highly recommend insuring your postage and getting a receipt for postage to us. For larger, heavier items, we can arrange for our courier to collect. The collection cost will be deducted from your refund.

f) Any free gifts or promotional offers received with the product must also be returned.

g) Baby Depot will refund the purchase price (excluding any courier/postal service charges) within a period of 14 days from the date of the return if all of our requirements are met. If you received a free shipping promotion, original shipping fees will also be deducted from your refund.

18. Faulty Goods: Please consult your users manual and the manufacturer helpline for faulty product issues. Most manufacturers prefer to handle their own replacements directly, making it quicker and easier to replace faulty items.

If you are unable to make arrangements with the manufacturer, we can assist provided that our requirements are met.

a) We accept faulty reports on products within seven (7) days receipt of order.

b) We may issue a replacement part or exhange depending on the circumstances and the specific manufacturers’ guidelines. We do not issue refunds on faulty goods.

c) If deemed necessary, Baby Depot Customer Service staff will advise you of a collection method to return the products. Depending on the nature and size of the product purchased, we will either arrange a courier collection, or request that you return the product directly to us.

d) A manufacturer’s guarantee will not apply if the fault arises from fair wear and tear, deliberate damage, accidental damage, negligence, abnormal working conditions, dropping, misuse or alteration, repair of the goods without manufacturer approval, or exposure to sand or water.

20. Unacceptable Returns: If you return an item to us outside the terms of our returns policy and Approval Guarantee and your statutory rights do not apply, we may not refund you. The item may be returned back to you at your expense.

Delivery Policy

21. Delivery is to addresses in the Republic of Ireland only. Credit card authorisation and address verification must be confirmed prior to processing an order and preparing that order to ship. Orders must be received before 1pm Mon-Fri (excluding holidays) to be processed same day.

22. Any date or time quoted for dispatch is to be treated as an estimate only. Whilst we make every reasonable attempt to deliver promptly and within the estimated time frame we cannot be held responsible for sudden stock shortages, manufacturing delays or unforeseen circumstances. However, if we cannot make delivery within 30 days of order we will contact you.

23. Deliveries must be signed for. If you are out when your order arrives, a card will be left with a contact number for you to call to arrange re-delivery or collection from the courier depot.

24. You must inspect your order immediately after delivery is complete. If any products are damaged, you must notify us within two (2) working days of the delivery. Baby Depot accepts no liability for loss or damage caused by the carrier. Risk shall pass to you at the time your order is despatched. Please report any delivery problems to us immediately at customerservice@babydepot.ie.

25. Failed Delivery: Regarding failed deliveries of products which have been returned to us owing to a breach of contract by the consumer; you will receive a letter from us, advising that you have seven (7) days to contact us to rearrange delivery. Failing this, the product will be returned to stock and a refund will be processed less an administration charge.

26. Some of our products may be shipped directly from our vendors and manufacturers. Because of this arrangement the items in your purchase may be delivered separately. Please check your delivery notification email for details.

Termination of Use

27. Baby Depot may, in its sole discretion, terminate your account or your use of the Baby Depot Web site at anytime. You are personally liable for any orders that you place or charges that you incur prior to termination. Baby Depot reserves the right to change, suspend or discontinue all or any aspects of the Baby Depot Web site at any time without prior notice.

Privacy

28. Baby Depot does not share any of your personal information with third parties. If you pay by credit card, we use PayPal to process payments. PayPal maintains the strictest security while processing your payment information. Baby Depot does not access or store any credit card details on file.

Complaints

29. We take all complaints very seriously. If you have cause to complain then please contact us in writing. We will respond in writing to all complaints within five (5) working days and will keep you informed throughout the complaints investigation process, and advise you of its outcome.


Irish legislation and the jurisdiction of the Irish courts apply to this agreement.
